§7 Duty to cooperate
(1) Until the repair is authorised or commissioned by Motorheld24, the Buyer may not make or allow any changes to be made to the warranty part.
(2) At the request of Motorheld24 GmbH, the warrantor is obliged to send the defective removed parts for

are to be sent and kept.
(3) To allow an on-site inspection of the used vehicle or a test drive of the used vehicle
before the repair order is issued. If necessary, an appointment for an inspection or
test drive will be arranged.

warranty coverage.
(5) The Buyer must state and prove that the used vehicle specified in the warranty claim has undergone the maintenance, inspection and
service work prescribed or recommended by the manufacturer (including the inspection of the air conditioning system as well as water, antifreeze and
oil changes) in accordance with the manufacturer's specifications or by a specialist automotive workshop.
(6) The Buyer must inform and confirm by email;
6.1 whether any tampering with the odometer or other influences on it have been made,
whether they are aware of any defect in the odometer and/or whether the odometer has been replaced. If so, the Buyer must state the respective mileage at which the
tampering, defect or replacement occurred.
6.2 that any pre-existing damage and parts clearly requiring repair on the used vehicle

specified in the warranty claim .

possibly orally or by telephone, if circumstances permit.
To what extent will damage assessment costs be reimbursed?
(1) Damage assessment costs, i.e. costs incurred by the warrantor in investigating and
establishing the damage to be replaced, will only be reimbursed if Motorheld24 has previously
requested the warrantor to carry out these measures and if a covered warranty claim exists
under these conditions. The costs of expert reports commissioned by the
warrantor to establish the extent of damage or the cost of repair will only be reimbursed if the appointment of the expert was
appropriate under the circumstances and if a covered warranty claim exists under these conditions. Reimbursement of these
expert costs is limited to an amount of €750 (incl. VAT) per covered warranty claim.
(2) The warrantor's claim for reimbursement of damage assessment costs is due within two
weeks of receipt of the invoice.
§10 Deposit

in the amount of €850. This deposit amount is due together with the purchase price.
(2) In addition, the Buyer undertakes to send the old / defective engine back to the Seller at their own expense within 3 weeks (from the
time of delivery). As soon as the old, defective engine has been fully received and inspected by the
Seller, the deposit will be refunded to the Buyer using the original
means of payment.

(3) If the Buyer no longer has an old, defective engine or refuses to return the old / defective engine,
the deposit will be retained and the Buyer must pay an additional €750 to the
Seller on top of the purchase price.

(4) When using the 'Assembly' service, the deposit payment is waived, as the old/defective engine
remains directly with the Seller during the replacement.
(5) Securely attach the old part to a Euro pallet after conversion and wrap it in plastic film .
§ 11 Liability for defects
(1) The Seller accepts no liability for material defects. The Seller is not aware of any defects
[alternatively: defects. The defects known to the Seller are those mentioned below;
no further defects are known to the Seller].
(2) The exclusion of liability under paragraph 1 does not apply if the Seller has guaranteed a specific quality of the
purchased item. Claims for damages due to grossly negligent or even
intentional breach of the Seller's obligations are also not excluded. The
exclusion of liability also does not apply to cases involving injury to life, body and health. Finally,
the exclusion of liability does not apply if the Seller has fraudulently concealed a defect.
(3) In cases of fraudulent concealment of defects, further claims remain unaffected. Statements,
drawings, illustrations, technical data, weight, dimension and performance descriptions contained in advertisements
or price lists are purely for informational purposes and do not constitute
guarantees of characteristics. Motorheld24 GmbH accepts no liability for the accuracy of this
information. With regard to the type and scope of delivery, only the information contained in the order confirmation
is decisive. Stated mileage refers to the odometer reading taken
at the time of removal or to the information provided by the suppliers.
§12 Warranty
1. For the sale of used, reconditioned parts, the statutory warranty under §437 ,439 , 440
and 441 BGB is accepted.

by email, and the warranty is not to be transferred.
4. A prerequisite for the warranty is the installation of the purchased spare parts by a specialist workshop. For
work contracts, the same warranty conditions apply. A corresponding / proper

a warranty claim is NOT possible.

defect exists for which the Seller is liable, the Buyer bears the full cost of the assessment .
10. In the event of a warranty claim, we reserve the right to inspect your vehicle at one of our partner workshops
within the EU and, if necessary, repair it. If you object to a repair outside Germany,
a maximum of the costs of a repair outside Germany will be reimbursed
(damage mitigation principle).
11. Only our own specifications and the manufacturer's product description are considered
as agreed regarding the condition of the goods, not other advertising or public appraisals .
12. After installing this engine, it must be ensured that the engine control unit has the latest software,
failure to comply with this will lead to loss of warranty.
13. After an oil combustion event, the diesel particulate filter, the catalytic converter and the lambda sensor
must be replaced with original parts or original replacement parts.
